Our Austin Auto Accident Attorney Seeks Compensation for Your Suffering

In 2009, Austin passed an ordinance that prohibited texting and driving.Studies have shown that texting while driving is at least as dangerous as driving under the influence of alcohol. According to the U.S. Department of Transportation, 3,179 people died in accidents involving distracted drivers in 2014. This is why Texas, along with many other states, has passed laws prohibiting drivers from using phones.

Understanding Texas Texting Laws

In 2009, the city of Austin passed an ordinance that prohibited texting and driving. Specifically, the law makes it illegal to view, send or compose a message while driving. It also makes it illegal to use your phone to browse the Internet while driving. In 2015, Austin distracted driving law banned drivers from talking on the phone while driving.

Outside of Austin, the Texas state law governs. For drivers over the age of 18, the state texting law only bans talking and texting while in school zones. Drivers younger than 18 are completely banned from texting and talking on cell phones while driving. There are some special provisions that apply to bus drivers as well.

How We Can Help

If you were hurt in a car accidenttruck accident, pedestrian accident, motorcycle accident or any other type of motor vehicle accident, cell phone records will show whether the other driver used a cell phone at the time. Our attorney will obtain these records as part of your case.

If the driver who hit you was texting or talking on the phone, then that gives us an advantage when negotiating with the insurance company, which may lead to a favorable settlement. If, however, the insurer refuses to treat you fairly, you can trust in our ability to present your case in court.
