In a personal injury case, the injured party is claiming past, present and future damages. In regard to past damages, they’re claiming past medical bills, lost wages and past pain, suffering and mental anguish because of the injury. Present means they’re claiming present pain and suffering and mental anguish from the accident and future damages is they’re claiming future medical, lost wages, pain and suffering and mental anguish in the future as a result of the accident. Wrongful death cases contemplate the loss of life of the individual. They also contemplate the loss of earnings to that individual in the future, particularly in the claim that’s brought by his children, her children or the spouse. Loss of consortium is a separate claim that’s used by a spouse and children in the State of Texas when a parent dies.
