On December 16, a former Target employee in Marshall, Texas filed a lawsuit alleging that Target failed to pay her $117,240 from a court agreement resulting from an on-the-job injury.
According to the lawsuit, the woman was injured at work when a co-worker quickly turned a pallet jack and shifted the momentum of a stacked, 200-pound load. The load fell off the pallet jacket, and the freight struck the former employee from behind. The woman fell down and into the end cap shelving.
After the accident, the woman required shoulder and knee surgeries. She was also fired from Target for missing work due to her work-related injuries.
Target is accused of breach of contract and violating the Texas Deceptive Trade Practices Act as well as the Business and Commerce Code by not paying their former employee. The woman is seeking $117,240 in damages, three times the initial amount for mental anguish and economic damages, punitive damages, attorney’s fees, interest and court costs.
